What’s the Difference Between a Conveyancer and a Settlement Agent?

In Western Australia, the terms conveyancer and settlement agent are often used interchangeably — and for good reason. In WA, a settlement agent is essentially a licensed conveyancer who specialises in handling the legal and administrative work involved in transferring property ownership.

The key difference is mostly about terminology and qualifications.
A settlement agent in WA must hold a specific licence under the Settlement Agents Act 1981, allowing them to manage property settlements for buyers and sellers. A conveyancer, on the other hand, is a broader term used across Australia to describe professionals who prepare contracts, conduct searches, liaise with banks, and ensure the legal transfer of property.

In states like NSW or Victoria, “conveyancer” is the standard term. In WA, “settlement agent” is the local equivalent — though many professionals use both titles.

Both roles focus on ensuring the property transfer is accurate, compliant, and completed on time. The main thing for buyers and sellers to look for is that the person handling their settlement is properly licensed, experienced with WA property law, and able to communicate clearly throughout the process.
